These Terms of Service (“Terms”) govern your use of the Newsix Local Solutions website and your purchase of advertising services from Newsix Local Solutions (“Newsix Local Solutions,” “we,” “us,” or “our”).
By purchasing an advertising placement, submitting an advertising request, or otherwise engaging our services, you agree to these Terms.
1. Our Services
Newsix Local Solutions provides local advertising and marketing services, including the creation and distribution of Community Cards featuring local businesses.
Our Community Card advertising service may include:
- Reserving an advertising placement
- Collecting your business and advertising information
- Creating or preparing your advertisement
- Including your advertisement on a Community Card
- Printing the Community Card
- Arranging distribution of the Community Card to the intended local area
The specific distribution area, approximate number of households, available advertising positions, deadlines, and distribution dates may vary by Community Card issue.
2. Advertising Placement
Advertising placements are subject to availability.
A placement is not considered confirmed until payment has been received and accepted by Newsix Local Solutions.
Newsix Local Solutions may limit the number of businesses participating in a particular industry, category, or service type.
Once your placement has been confirmed, you agree to provide the information, logo, images, promotional details, and other materials reasonably required to create your advertisement.
3. Payment
Payment is required according to the price and payment instructions provided at the time of purchase.
All prices are in Canadian dollars unless otherwise stated.
Your advertising placement is considered confirmed once payment has been received.
4. No Refunds After Advertisement Creation
All advertising payments are final once payment has been received and Newsix Local Solutions has begun creating or preparing your advertisement for the Community Card.
Because advertising placements involve reserving limited space, preparing advertising materials, designing the advertisement, and coordinating the printing and distribution of the Community Card, there are no refunds once your payment has been received and your advertisement has been created or preparation of your advertisement has begun.
This means that if you change your mind after your advertisement has been created, you decide that you no longer wish to participate, or you otherwise request cancellation after production has begun, you will not be entitled to a refund, subject to any rights that cannot legally be excluded under applicable law.
5. Completion of the Advertising Service
Once payment has been received and an advertisement has been created, Newsix Local Solutions will continue with the advertising process through completion of the Community Card campaign.
This includes, as applicable:
- Preparing the advertisement
- Finalizing the Community Card
- Sending the card for printing
- Coordinating distribution
- Completing the planned distribution of the Community Card
A customer may not cancel the campaign simply because they change their mind after the advertisement has entered production.
The advertising service will continue through the planned completion of the campaign.
6. Advertisement Design and Approval
Customers are responsible for providing accurate business information, contact information, pricing, promotional claims, logos, photographs, and other materials supplied for their advertisement.
If Newsix Local Solutions creates or modifies an advertisement on your behalf, you are responsible for reviewing the information provided and notifying us of any errors or requested changes within the applicable review period.
Once an advertisement has been approved, or once the applicable production deadline has passed, changes may not be possible.
Newsix Local Solutions is not responsible for errors resulting from inaccurate, incomplete, outdated, or late information supplied by the customer.
If a customer has paid for an advertising placement but fails to respond to design requests, provide necessary materials, or approve their advertisement within the specified timeframe, Newsix Local Solutions reserves the right to proceed with publication using a standard advertisement template created by the Newsix Local Solutions team.
This advertisement will be designed using the business information available to us and will be published without further approval to ensure production and distribution deadlines are met.
7. Customer-Supplied Materials
You represent that you have the necessary rights and permissions to provide any photographs, logos, graphics, trademarks, text, promotional offers, or other materials submitted for use in your advertisement.
You grant Newsix Local Solutions permission to use those materials for the purpose of creating, printing, publishing, and distributing your advertisement as part of the Community Card campaign.
You remain responsible for the legality and accuracy of claims made in your advertisement.
8. Advertising Content
Newsix Local Solutions reserves the right to refuse, modify, or remove advertising content that we reasonably believe:
- Is illegal or misleading
- Infringes another person’s intellectual property rights
- Contains offensive or inappropriate material
- Violates applicable laws or regulations
- Could create legal liability for Newsix Local Solutions
- Does not comply with the intended purpose or format of the Community Card
If an advertisement cannot be used because of prohibited or unlawful content supplied by the customer, the customer remains responsible for the payment, subject to any rights provided by applicable law.
9. Distribution
Newsix Local Solutions will make reasonable efforts to arrange distribution of the Community Card to the intended geographic area and approximate number of households stated for the applicable campaign.
Distribution dates may change due to circumstances including printing delays, postal or delivery issues, weather, holidays, supplier delays, or other circumstances outside our reasonable control.
A stated household count represents the intended distribution quantity and is not a guarantee that every individual household will receive or retain a Community Card.
10. No Guarantee of Business Results
Newsix Local Solutions provides advertising exposure and marketing services.
We do not guarantee that an advertisement will result in:
- A specific number of leads
- A specific number of customers
- Sales or revenue
- Website visits
- Phone calls
- Inquiries
- Bookings
- Any particular return on investment
Advertising results can depend on many factors outside our control, including the offer, business, pricing, market conditions, consumer behaviour, and the effectiveness of the advertisement.
11. Delays and Circumstances Outside Our Control
Newsix Local Solutions will make reasonable efforts to complete each campaign as planned.
However, we are not responsible for delays, interruptions, or failures caused by circumstances outside our reasonable control, including:
- Printing problems
- Postal or delivery delays
- Weather
- Natural disasters
- Strikes or labour disruptions
- Supplier failures
- Technology failures
- Government restrictions
- Power or internet outages
- Other circumstances beyond our reasonable control
Where reasonably possible, we will communicate material changes affecting the campaign.
12. Changes to an Advertising Campaign
Newsix Local Solutions may make reasonable changes to the layout, design, dimensions, distribution schedule, or production process when necessary to complete the campaign.
We will make reasonable efforts to preserve the substance and intended purpose of the customer’s advertising placement.
13. Intellectual Property
Newsix Local Solutions retains ownership of its website, branding, original designs, layouts, marketing materials, and other intellectual property created by Newsix Local Solutions unless otherwise agreed in writing.
Customers retain ownership of their business names, logos, photographs, trademarks, and other materials they provide, subject to the licence granted to Newsix Local Solutions to use those materials for the advertising campaign.

We are not responsible for the independent acts, omissions, policies, or failures of third-party service providers except to the extent required by applicable law.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Newsix Local Solutions will not be responsible for indirect, incidental, special, consequential, or business losses arising from the use of our advertising services, including lost profits, lost opportunities, or loss of expected advertising results.
Nothing in these Terms is intended to exclude or limit any liability, right, or remedy that cannot legally be excluded or limited under applicable law.
17. Disputes
